1. Types of data collected

Kickoff Logistics LLC ("we," "us," or "our") may collect the following personal information:

• Contact information: name, company name, email address, and phone number (including mobile number)
• Shipment information: pickup and delivery locations, pickup dates, equipment needs, and cargo weight and details
• Communications: messages you send us by web form, email, phone, or text, and your SMS consent choice
• Operational records: bills of lading, rate confirmations, proof of delivery, delivery signatures, seal numbers, reefer temperature logs, and truck GPS location data
• Billing and financial information: business billing address, payment terms, invoice and payment history, and tax identification numbers such as an EIN
• Driver and job applicant information: information described in Section 8
• Incident and claims information: accident reports, cargo damage or loss claims, photos, and related insurance information
• Technical information: IP address, browser type, device type, and pages visited, as logged by our website hosting provider

2. How data is collected

We collect information in the following ways:

• Website forms: when you submit the "Request a haul" form or the Contact form on our website, including the optional SMS consent checkbox
• Phone calls, texts, and email: when you contact dispatch or we communicate about a shipment
• Business documents: rate confirmations, bills of lading, and delivery paperwork
• Automatically: through server logs kept by our website hosting provider. We do not use advertising or tracking cookies (see Section 11).

3. Purpose and use of data

We collect and use your information to:

• Respond to load requests and provide quotes
• Schedule, dispatch, track, and deliver shipments
• Send shipment updates, delivery confirmations, and billing communications by email, phone, or text (texts only if you have opted in)
• Answer questions and provide customer support
• Meet safety, insurance, and FMCSA and U.S. DOT recordkeeping requirements
• Resolve claims, billing questions, and disputes
• Keep our website working and secure

4. Data sharing

We do not sell or rent your personal information. We share it only when needed to provide our services or when required by law, including with:

• Our drivers, and the shippers and receivers involved in your shipment
• Service providers who help us operate, such as ELD and telematics, website form delivery (FormSubmit), email, text messaging, accounting, factoring, and website hosting providers. They may use your information only to perform services for us.
• Insurance companies, in connection with coverage or claims
• Government agencies, law enforcement, or courts, when required by law, regulation, or legal process
• Freight brokers, shippers, and receivers, limited to the shipment details needed to cover and deliver a load
• Background screening companies, drug and alcohol testing laboratories, and the FMCSA Drug and Alcohol Clearinghouse, for driver hiring and compliance
• Banks, payment processors, and factoring companies, for invoicing and collections
• Our attorneys, accountants, and auditors, when needed for professional advice
• A buyer or successor, if our business is sold or merged

5. SMS and mobile information

If you opt in to receive text messages from Kickoff Logistics LLC, we use your mobile number only to send the types of messages described in our SMS Terms & Conditions.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. You can opt out at any time by replying STOP, and text HELP to (612) 444-0548 for help. Message and data rates may apply. Message frequency may vary.

6. Shipment and business confidentiality

We treat the business information our customers share with us as confidential. This includes shipment volumes, lanes, pickup and delivery locations, commodity details, rates, and customer and receiver names.

• We do not share one customer's shipment details or rates with another customer or competitor.
• Shipment information is shared only with the people needed to move the freight, such as the assigned driver, the shipper, the receiver, and, where applicable, the broker on the load.
• Load paperwork is handled by authorized staff and drivers only and is not left unattended in trucks or offices.

7. Vehicle tracking and location data

Our trucks use electronic logging devices (ELDs) and GPS telematics, as required by federal regulations and to provide shipment tracking. These systems record information such as truck location, speed, engine hours, and driver hours of service.

• We use this data to track shipments, give customers accurate pickup and delivery updates, plan routes, comply with hours-of-service rules, and improve safety.
• Location updates shared with a customer relate only to that customer's shipment and only while the load is in transit.
• Hours-of-service and ELD records may be reviewed by FMCSA, state enforcement officers, and auditors, as required by law.

8. Driver and job applicant information

When drivers and job applicants apply to or work with Kickoff Logistics LLC, federal motor carrier regulations require us to collect and keep certain information. This may include:

• Contact details, employment history, and references
• Commercial driver's license (CDL) details, endorsements, and DOT medical certificate
• Motor vehicle records and safety performance history from previous DOT-regulated employers
• Pre-employment and ongoing drug and alcohol testing results, and FMCSA Drug and Alcohol Clearinghouse queries
• Background check results, with your written authorization as required by the Fair Credit Reporting Act
• Payroll, tax, and banking information for direct deposit

We use this information to evaluate qualifications, meet FMCSA driver qualification and testing rules, process pay, and maintain safety records. Drug and alcohol testing records are kept confidential and are released only as permitted by federal regulations (49 CFR Part 40) or with your written consent. Driver files are available only to authorized personnel.

9. Billing and payment information

We collect billing and payment information to invoice for freight services and receive payment. We do not store full credit card or bank account numbers on our website, and our website forms never ask for payment details. If we use a factoring company or payment processor, it receives only the invoice and payment information it needs to process payment.

10. Regulatory, safety, and legal disclosures

As a federally registered motor carrier (USDOT 3220304, MC-1007684), we may disclose information when required or permitted by law, including:

• To the FMCSA, U.S. DOT, and state agencies during compliance reviews, audits, and roadside inspections
• To law enforcement or courts in response to subpoenas, warrants, or other legal process
• To insurance companies and adjusters in connection with accidents or cargo claims
• To protect the safety of our drivers, the public, or the freight we carry, or to prevent fraud or theft

11. Cookies and third-party services

Our website does not use advertising cookies, analytics trackers, or tracking pixels. Our pages load fonts from Google Fonts and page styling from a content delivery network, and our forms are delivered through FormSubmit. These providers may receive your IP address and browser information under their own privacy policies. Links to other websites, such as the U.S. DOT SAFER system, lead to sites we do not control.

12. Data retention and security

We keep information only as long as needed for operations, billing, claims, and legal requirements, and then securely delete, shred, or dispose of it. Required retention periods include:

• Driver qualification files: for the length of employment plus three years
• Hours-of-service and ELD records: at least six months
• Drug and alcohol testing records: up to five years, depending on record type
• Shipment, billing, and tax records: as long as needed for claims, accounting, and tax requirements

Our safeguards include restricting records to authorized staff, password-protecting business systems, and keeping paper driver files in secure storage. We use reasonable administrative, technical, and physical safeguards to protect your information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

13. Your rights

You have the right to:

• Access the personal information we hold about you
• Update or correct information that is inaccurate or incomplete
• Delete your personal information, subject to records we are legally required to keep
• Opt out of text messages at any time by replying STOP, or of other communications by contacting us

To make a request, contact us using the information in Section 16. We may need to verify your identity first. Depending on your state, you may have additional rights under state law, and we will not treat you differently for using them.

14. Children's privacy

Our services are for businesses and adults. We do not knowingly collect personal information from children under 13, and all commercial drivers must meet federal minimum age requirements.

15. Changes to this policy

We may update this policy from time to time. When we do, we will change the effective date at the top of this page.
